The neighborhood does not have a formal/legal HOA. They have CCRs but no way to enforce. If you want to use the pool you pay a pool fee. Each house pays $25.00 for beautification. There is no attorney, management company, nothing. There is a "board" but they have no legal right to do any thing.
Some neighbors want to make the HOA a legal one. Can they do this? Would I be forced to join and pay fees?
I want to purchase in this neighborhood but the seller has put up a shed that does not meet the CCRs. Nothing has been done because the "HOA" would have to go to court and they aren't willing at this point. They want to form the HOA in order to enforce these rules. There is no common area and the city takes care of lights/streets etc..
I don't want this to `come back on me as it would be very expensive to fix.
I rent out a house I used to live in. Because my interest rates have gone up, I can't afford to rent it out to a family, so for the last six years, I've been renting out the rooms to individuals, and sometimes relatives. It barely pays, but I've been hanging on. I live minutes away, so am constantly over there, fixing up & monitoring things, nearly every day. It's quiet, no parties, on end of cul de sac. Sometimes the tenants are doctors & only live there a couple of months. My next door neighbor has always been mean. He has complained to the HOA, saying I run a "hotel". That's not at all true, 3 of the tenants have lived there 5 yrs. But HOA says the CCRs state "no multiple families" so they want to fine me. I don't have multiple families. In fact my house has very few people & cars. The neighbor is racist & a bigot, he hates gays & one tenant is gay. I don't know what to do. If I rent to a family, I will have to foreclose. If I rent to individuals, I get fined.
We bought a Property in Westwood Shores Subdivision of Trinity Texas, and when we bought it I got in contact with the POA (Property Owners Association) and asked about the CCRs and they directed me to a website. I downloaded the CCRs (which were written in the 1970s) and they mention a "Country Club Dues", when I asked about them they told me they did not handle that, but nothing else. I never received an invoice from the country club and now months later they say I owe them $900.
Can they legally make me pay for a Country Club that I am too far away to use?
Can they force me to join a country club just by purchasing a piece of land?
Is all of this legal?
I talked to the people with the POA and they said "Due to a lawsuit the CC dues were seperate", misunderstanding on my part here, but I can't seem to get a sraight answer if they are no longer part of the CCRs or what.
I never did recieve an invoice, all of a sudden I had a collection notice 10 months past due.
